“Vienna Airport Transfers” provides services based on the following terms and conditions, service descriptions and price lists. Differing terms and conditions do not apply, even though “Vienna Airport Transfers” does not specifically object to them. Discrepancies from these conditions require the explicit written acknowledgement from “Vienna Airport Transfers”. A contract is concluded only if it is confirmed by “Vienna Airport Transfers”.
The scope of services shall be determined solely by the written order confirmation by “Vienna Airport Transfers” or, in a subsidiary manner, by the written offer from “Vienna Airport Transfers”. Information contained in brochures, service catalogues, price lists and similar information is only binding to the extent that it is specifically referred to. The transport occur according to the regulations of the StVO and the PbefG. Passengers must follow the instructions of “Vienna Airport Transfers” or the chauffeur. “Vienna Airport Transfers” is entitled to exclude guests from transportation if they act against the instructions, or if they pose a threat to road traffic regulations due to negative impact on the chauffeur. In this case, “Vienna Airport Transfers” will charge the full fare including the fixed price or mileage price and all ancillary and special services.
“Vienna Airport Transfers” must be notified promptly of any change on the agreed pick-up time, for any reason whatsoever. Losses caused by not immediate notification shall be charged to the customer.
The rates include the legislative VAT in the appropriate legal amount. The rates valid on the day of booking confirmation apply. The flat rates not listed in the price list can only be agreed in writing and apply only for the agreed date of travel and rental period. Any additional period and distance will be charged according to the valid price list. Additional costs due to delays shall be charged to the customer, unless the delays are the fault of “Vienna Airport Transfers” or the chauffeur. The fare includes the transport of passengers with normal luggage; the transport of bulky cargo requires a separate agreement.
“Vienna Airport Transfers” reserves the right to charge a down payment of up to 50 % of the total price or, before accepting an order, to request a blank debit voucher issued on “Vienna Airport Transfers” from a valid credit card. Remaining payments are due for payment within the periods specified on the invoice. The timeliness of payment depends on receipt of the amount for unconditional disposal of “Vienna Airport Transfers”. In the case of payment by cheque, the claim shall only be deemed paid after final complete crediting. Payments are always used to settle the latest request. If the customer is late with payment, “Vienna Airport Transfers” shall charge interest at a rate of 5 percentage points above the base interest rate, subject to the assertion of further claims for damages. For the second and each further reminder – €10 reminder fee will be charged. The customer reserves the right to determine a lesser damage.
Cancellations shall only become effective if occur in writing or are confirmed in writing by “Vienna Airport Transfers” upon verbal declaration. Access to “Vienna Airport Transfers” is essential for the timeliness of written cancellations. Cancellations up to and including 24 hours before the contractually agreed start of the trip are free of charge. “Vienna Airport Transfers” will charge a portion of the basic fare as compensation in the event of cancellations. This portion amounts to:
“Vienna Airport Transfers” charges expenses regardless of the timeliness of the cancellations, if these have already been incurred.The customer is expressly permitted to prove that “Vienna Airport Transfers” has incurred no damage or occured lower damage. “Vienna Airport Transfers” reserves the right to withdraw from the contract in whole or in part if the customer ceases payment, becomes insolvent or if it can be assumed due to external circumstances that the services will be misused or if the customer violates his obligations under these contractual provisions.
The customer shall notify “Vienna Airport Transfers” immediately of any change in his name, (billing) address, legal form and bank details. The customer is also obliged to provide the necessary information on passengers, time and place of service provision. If the customer omits immediate notification, he shall be liable for damages that would have been avoided by timely notification. The customer is obligated, also on behalf of the passengers, not to misuse the services of “Vienna Airport Transfers”, in particular:
If a customer violates the aforementioned obligations, “Vienna Airport Transfers” is entitled to take all necessary measures to remedy the misuse. In the event of culpable infringement, the customer shall be liable to “Vienna Airport Transfers” for damages.
In the event of a contract being concluded, “Vienna Airport Transfers” collects and processes the personal data provided by the client in the system of “Vienna Airport Transfers” and uses these for the duration of the contract, i.e. for order processing and invoicing. Personal data is all information on the basis of which a person can be identified directly or indirectly, e.g. name, address, e-mail address, date of birth, occupation, bank account details, etc. Any special requests (e.g. smokers / non-smokers) will also be determined and processed. The client may request “Vienna Airport Transfers” at any time to correct, delete or block his personal data stored in “Vienna Airport Transfers”. For the purpose and for the duration of the credit assessment, “Vienna Airport Transfers” will pass on the personal data required for this purpose by the client to the company (name and address) commissioned by “Vienna Airport Transfers” to comply with the statutory data protection regulations. Any collection, processing and use of personal data beyond the above points requires the client’s consent. The client has the right to revoke his consent at any time for the future use, which the client can ply at any time vis-à-vis “Vienna Airport Transfers” by sending an e-mail to office@viennaairporttransfers.at “Vienna Airport Transfers” provide the client with free information about personal data stored by us.
Austrian law shall apply exclusively to all legal relationships between “Vienna Airport Transfers” and its customers. Place of jurisdiction and performance is Vienna.
Should one or more of the above conditions be ineffective, the remaining conditions remain unaffected by the ineffectiveness. Invalid clauses shall be replaced by the statutory provisions.
